Equipment Recovery Notice

In the event of an equipment default, overdue rental, or suspected theft, NorthPoint reserves the right to share your personal information — including name, address, vehicle information, and job site location — with law enforcement, repossession agents, and legal counsel without prior notice to you, as permitted under our rental agreement and applicable New Hampshire law.

Section 6

Data Retention

NorthPoint retains your personal information for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.

  • Active Customer Records: Retained for the duration of your customer relationship plus seven (7) years following your last transaction, consistent with New Hampshire contract and commercial law statutes of limitations
  • Rental Agreements & Contracts: Retained for a minimum of seven (7) years from the date of the last transaction under the agreement
  • Financial Records & Payment Information: Credit card data is retained by our payment processor for up to twelve (12) months as disclosed in our rental agreement; full payment records retained for seven (7) years
  • Damage & Incident Records: Retained for a minimum of seven (7) years or until final resolution of any related claim or litigation, whichever is later
  • Identity Verification Documents: Retained for a minimum of three (3) years following your last rental transaction
  • Website Analytics: Aggregated and anonymized data may be retained indefinitely; identifiable data retained for up to twenty-four (24) months
  • Marketing Records: Retained until you opt out or request deletion, subject to applicable law

Upon expiration of the applicable retention period, we will securely destroy or anonymize your personal information, subject to any legal hold obligations.

NORTHPOINT’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THIS PRIVACY POLICY SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE AMOUNT YOU PAID TO NORTHPOINT IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless NorthPoint Equipment Rentals LLC, its members, managers, employees, agents, successors, and assigns from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of this Privacy Policy; (b) your misrepresentation of any information provided to NorthPoint; (c) your unauthorized use of our website or services; or (d) your violation of any applicable law or regulation in connection with your use of our website or services.

Any dispute, claim, or controversy arising out of or relating to this Privacy Policy that cannot be resolved informally shall be submitted to binding arbitration administered by a mutually agreed arbitration service in Grafton County, New Hampshire, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

The exclusive venue for any legal proceedings not subject to arbitration shall be the courts of Grafton County, New Hampshire, and you consent to personal jurisdiction in such courts.
